A lawyer explained this:  it's not the job of plaintiff's counsel to determine the extent of participation (if any) in a loss, but to identify all parties that stood to benefit from the circumstances leading up to the loss and to let the court/jury determine who should be held liable and to what degree.

Fact:  Our laws are purposefully written to be subject to interpretation by a Grand Jury and/or Jury.

Fact:  Our laws are purposefully written to be subject to interpretation by a Grand Jury and/or Jury.

There is more leeway in civil matters as well.

Part of the reason laws are written with some interpretation in mind is because it's not possible to write a "thou shalt not..." law that covers every possible thing/condition/act in specificity without leaving things out or making it easier to 'game' the system.
