Twenty years ago it wouldn't have been a work comp claim-just a bruised ego.  Unfortunately, the older we get the less we bounce!

Hope it goes well.  Of course, 3 sold out shows to mix with one good shoulder is a better problem than two good shoulders and no shows to mix.
Misery loves company.  I hope you can find a little humor in my dealings with the local hospitals.


On the way to the hospital-1 I hit a water-filled pothole and bent the heck out two of my new  two-week old rims. Mis-diagnosed baseball finger as a soft tissue injury.


Earlier that year, my wife went over the handlebars of the bike in front of hospital-2. Mis-diagnosed a broken bone in her hand as a soft-tissue injury.  By this point, we were getting to be really good friends with Dr. Dennis, the hand specialist at OSMC.


Preparing the house for hurricane Irene to hit, the rain had just started, and I remembered I wanted to check the downspout by the garage.  So up the now-damp ladder I went - in flip-flops, I fell off the 4-foot ladder and was on the concrete drive in no time.  Neighbor found me and called the rescue squad.


Hospital-3 x-rayed my ankle and declared the ankle fine - must be a soft-tissue injury.  Sent me home. Ortho Dr. on Monday diagnosed major damage to the mid and lower foot - dislocated, broken and crushed bones, and tendon ripped from the bone. But the ankle was fine.  And I didn't even get the "first casualty of hurricane Irene in the ER" award.  Someone beat me out by 5 minutes. 

The new kids at the ortho Dr. had a fun new lesson - "I've read about them before, but never actually have seen any" the young-uns said looking at the fracture blisters on my now 25" round foot.


I was doing all my jobs from a wheelchair for six months - and rehab for three. but I had both hands! 


Seriously, that's terrible luck, Bill.  Hope the break was clean, and heals well and fast.  Just glad yours wasn't a soft tissue injury too.


ps. I won't tell you about the time I sliced my scalp open on the first hole playing golf with my wife and her father.  They said it looked nasty, and I should have it looked at. They would meet me on the back nine.  Drive safe!  Don't let the blood get in your eyes! Honest!

Remember that one day when the temperature was -3 and the windchill was -14 and you where out at the shop and fell and broke your right shoulder?!?!?  After all of that you had to drive to the hospital to get it your shoulder set....Oh wait that's how my day has gone so far.  Finally home.  Oh, and more good news, shows pickup this coming weekend with three sold out shows and one arm to mix with.  This is going to be fun.

Hey Bill, if you remember it that well then the hospital gave you the wrong or not enough drugs! ;-)

It's always an interesting day when the boss makes for a worker's compensation insurance claim.

Workman's Comp, you know I am not taking anytime off.  I have been at the shop since 7:30 this morning.

I was thinking more about the medical expenses, physical therapy, etc.  That's why you're insured.  Talk to the claims folks, but NEVER say "I did something stupid..." as they will claim you admitted willful negligence and will attempt to disqualify you from this or any future claims regarding these injured areas of your body.

You should get moving as there is a limit to bringing your claim (here in Kansas, it's 2 weeks; done to relieve employers of repetitive motion injury claims).

A worker has no claim to suit in most states.  The employer's negligence would have to be careless disregard, and/or willful disregard in order bring a lawsuit.

If the landlord is responsible for the fault and the landlord is the business, the workman's comp is the primary insurance.  IF the landlord is responsible for the loss and the landlord is not the business, standard tort law applies.
