I was suggesting following the code requirements for cable fill and not that it would be a code violation to not follow them, in this case that is two different things but I can see it being confused.If fill was a code requirement, not following it would be a code violation.
As Don points out there is no NEC code requirement for communications cable fill. The NEC is only concerned with safety issues, not design or operational issues. Whether or not you can pull a communications cable through a conduit without damaging it is not an issue that impacts the life and safety of the building occupants or the safety of the property.
The place to look for fill requirements is the manufacturer of the cable you are using. Size of the cable is not the only consideration when determining cable fill. As has been noted the jacket material and the conduit itself play a role as does the amount of pulling tension the cable can safely withstand. Don't be tempted to do what sparkie does, that is use the code fill table for an equivalent sized THHN wire.
